Rental agreement

The rental agreement, in plain English

This is what you agree to when you rent from us. We wrote it the way we would explain it standing in your driveway, because terms nobody reads protect nobody.

Updated August 2026 · Ontario · prices in CAD · 13% HST extra

The deal

You are renting a specific unit for the dates we confirmed by text. From the moment it leaves our yard — or comes off the float in your driveway — until it is back with us, it is yours to use and yours to look after.

A booking request is not a booking. Nothing is reserved until we text you back to confirm, and the rental is agreed when we do. Once we confirm, the dates are yours and the calendar shows the unit as spoken for.

The rental is for you, at the address you gave us. Please do not re-rent, lend or sub-let the unit to somebody else, and do not move it to a different job site without telling us first — we need to know where our equipment is.

Money, HST and the deposit

Rates are per day and per week, before tax. A week is seven days. The quote applies the weekly rate automatically whenever it comes out cheaper, so you never pay more than the weekly rate for seven days. There is no weekend rate — book the days you need.

HST at 13% applies to the rental and to any delivery fee. The deposit is not a purchase, so it is never taxed. Every quote shows the rental, the delivery, the HST and the total separately before you send anything.

If a rate on the site is obviously wrong — a missing digit, a decimal in the wrong place — we tell you before we confirm, and we are not bound by it. That works both ways, and it is one of the reasons the confirmation text exists.

The deposit is refundable, not a fee. It is listed on its own line, away from the rental price, and it comes back in full when the unit comes back in the shape it left. We only draw on it for damage from misuse, missing fuel, or a late return that costs us — and we text you an itemized breakdown before a dollar of it moves.

The deposit is sent by Interac e-Transfer to kempenfeltrental@gmail.com, and it is returned the same way once the unit is back and checked over. We take no card payments of any kind. The rental itself is settled when the unit changes hands.

The deposit is not a limit on what you owe. It is what we can draw on without asking twice, not a cap on the repair bill. If damage from misuse costs more than the deposit, you owe the difference — we send you the invoice, the deposit comes off it, and we work out the rest with you. Anyone who tells you a $500 deposit covers a $40,000 machine is doing you no favours.

Fuel and cleaning

Gas units and the Toolcat go out with a full tank. Bring them back full. If they come back short we refuel at cost and take it from the deposit — no mark-up, and we show you the receipt.

Reasonable dirt is expected; that is what the machines are for. Coming back caked in concrete, manure or paint is not reasonable dirt, and cleaning time comes out of the deposit at cost.

Days, late returns and extensions

A rental day is a calendar day, pickup to return. Days are counted inclusively: pick up Monday, bring it back Wednesday, that is three days.

Need more time? Text us before your return day. If nobody is booked behind you, we add the days at the same rates and the weekly cap still applies. If someone is waiting, we will tell you straight so you can plan around it.

An unannounced late return is billed at the day rate against the deposit, because it usually means somebody else is standing in their driveway waiting for a machine that has not shown up. One text avoids all of it.

Cancelling and changing dates

Cancelling is free before the unit leaves our yard. Text us and you are done — the deposit is never touched on a cancellation.

If our truck has already left the yard for your delivery when you cancel, the $95 trip fee applies. That is the only cancellation charge there is.

Weather is not your fault. If rain writes off a pressure-washing weekend, text us and we move you to the next window the unit is free at no charge, rather than have you pay for days you cannot use.

Damage, breakdowns and wear

Normal wear is on us. Belts, hoses, blades and tires wear out; that is our cost of doing business, and we maintain the fleet between rentals so it does not become yours.

Damage from misuse is on you, and comes out of the deposit first. If the repair costs more than the deposit, we will show you the invoice and work it out with you like adults.

If something breaks or stops working right, stop using it and text us immediately. Running a machine that is already hurt is how a $200 repair becomes a $2,000 one. If the fault is ours, we fix it or swap it and you do not pay for the days you lost.

Safe use — the hard rules

These are not fine print. They are the rules that keep people out of hospital.

  • Everything: nobody operates our equipment impaired. Read the controls before you start, wear eye and ear protection where it matters, and keep kids and pets away from a running machine.
  • Toolcat: valid driver's licence, 21 or over, and you take the walk-through when we unload — about 15 minutes. Seat belt on, nobody rides who is not in a seat, and the loader arm is not a lift for people.
  • Generator: a connection to a house panel goes through a proper transfer switch installed by an electrician. Never backfeed through a wall outlet — it can kill the hydro crew working on your line. Run it outdoors, away from windows and doors.
  • Pressure washers: the wand can cut skin. Never point it at a person or an animal, and start further back than you think you need to on wood, mortar and siding.
  • Trailer: your tow vehicle needs a 2" ball, working 4-pin wiring and valid insurance. Check your coupler and chains before you pull away, obey posted limits, and remember a loaded trailer stops slower than you do.

While the unit is with you

You are responsible for the unit while it is out — including theft and vandalism — so lock it up overnight and keep the trailer hitched to something or locked at the coupler. On the trailer specifically, Ontario auto insurance on the tow vehicle normally extends to a trailer it is towing; check your policy if you are not sure.

You are also responsible for the work you do with it. Call locates before you dig, know where your septic bed and utilities are, and do not lend the controls to somebody who should not be running it.

When we can say no

Rarely, we have to cancel: a unit comes back from the previous job broken, a storm makes the float unsafe, or conditions on site are not safe to unload into. If we cancel on you, you pay nothing — no rental, no trip fee, no deposit — and we will tell you as early as we know.

We can also end a rental early and collect the unit if it is being used unsafely or somewhere other than the address you gave us. That has never happened. We would rather it stayed that way.

Ontario law

This agreement is governed by the laws of Ontario and the laws of Canada that apply in it. If part of it turns out to be unenforceable, the rest still stands. Nothing here takes away a right you have under Ontario law that cannot be signed away.

Questions

If something here is unclear, ask before you book — kempenfeltrental@gmail.com, or reply to the text thread if you are already booked. These terms apply to every rental and you accept them when you send a request and again when the unit changes hands.

Most of what people ask is already answered in plain language on the FAQ.
